Smithtown, NY – March 29, 2017 – On March 28, 2017, at approximately 5:30 PM, Troopers from SP Brentwood responded to a single car personal injury auto accident on the Sunken Meadow State Parkway near exit SM5, in the Town of Smithtown
 
The operator of a 2011 Infiniti, Jonathon M. Capelluto, 19, of Commack was traveling southbound on the Sunken Meadow Parkway when he lost control of his vehicle and struck an exit sign, a light pole, and then a tree. Capelluto was treated and released at Huntington Hospital for minor injuries. 
 
Capelluto was found to be intoxicated and was subsequently arrested for DWI under Leandra’s Law due to the fact that there were two 15 year old passengers in his vehicle. Capelluto was also found to be in possession of marihuana.
 
Capelluto was charged with two counts of  Aggravated DWI (Leandra's Law, class E felony), two counts of Endangering the Welfare of a Child (A Misd.), Unlawful Possession of Marijuana and traffic violations. Capelluto will be arraigned in Suffolk County 1st District court on March 29, 2017. The two 15 year old passengers were turned over to their parents.
 
A criminal charge is an accusation. A defendant is presumed innocent until and unless proven guilty.
