GranuFlo Lawsuit News: The Rottenstein Law Group LLP Notes the Submission of Proposed Cases For Bellwether Trials in Federal MDL

Rockville Centre, March 31st, 2014 - Hundreds of GranuFlo lawsuits have been filed by plaintiffs who allege injuries caused by the kidney dialysis chemical, or by family members who have filed wrongful death claims on behalf of loved ones who suffered fatal cardiac events following routine dialysis treatments. The Rottenstein Law Group LLP acknowledges that cases consolidated into the GranuFlo multidistrict litigation currently underway in the U.S. District Court for the District of Massachusetts (In re: Fresenius GranuFlo/Naturalyte Dialysate Litigation, MDL No. 2428), are about to be chosen for upcoming bellwether trials, according to court documents. Legal counsel representing Fresenius Medical Care, the manufacturer of GranuFlo, and plaintiffs, chose twenty cases out of the hundreds that have been consolidated into the MDL for possible bellwether trials. During a Status Conference that took place on March 28, both parties reviewed those cases, further reducing the number from which bellwether trials will be chosen from. Specific cases and trial dates will likely be announced soon.

“Bellwether trials are an especially important part of the legal process when it comes to personal injury litigation,” said Rochelle Rottenstein, principal of the Rottenstein Law Group. “These trials can help predict how juries will consider evidence in cases involving similar claims.”

Since the GranuFlo recall was announced in March 2012, lawsuits alleging that Fresenius Medical Care failed to warn physicians and patients about the dangers of receiving GranuFlo during dialysis treatments have been filed in federal and state courts across the country.  A New York Times article broke the news of an internal company memo that acknowledged a significant increase in patient deaths, apparently caused by inappropriate dosages of GranuFlo. The company did not publicly disclose this information, but when word leaked to the U.S. Food and Drug Administration (FDA), the company was forced to recall GranuFlo, and give strict instructions to its large network of dialysis clinics to cease administering it to patients.
