The Nassau County Police Department reports the arrest of a Glen Cove man for a DWI – Leandra’s law on Sunday, June 23, 2019 at 7:58 am.
 
According to police, an Old Westbury Police officer observed Elmer G. Martinez–Cartagena, 28, operating a 2007 Nissan west on Jericho Turnpike failing to maintain his lane as well as not signaling when changing lanes. The officer engaged his emergency lights and initiated a car stop in the vicinity of Jericho turnpike and Powell lane in Westbury. 
 
An investigation was conducted and it was determined that the defendant Martinez–Cartagena was operating his vehicle while under the influence of an alcoholic beverage. He was then placed into police custody without incident. The defendant also had in his vehicle his 1 year old daughter seated in the rear passenger child seat. The infant was released to a family member that responded to the scene. There were no injuries reported.
 
The defendant Elmer G. Martinez–Cartagena is charged with Aggravated Driving While Intoxicated (Leandra’s Law) as well as Driving While Intoxicated 1192.3 and 1192.2,  Endangering the Welfare of a Child, and numerous New York State Vehicle VTL violations.
 
Martinez – Cartagena was arraigned on Monday, June 24, 2019 at First District Court in Hempstead.
