Hempstead Man Arrested for Driving While Intoxicated with Infant in Front Seat

Hempstead, NY - December 22nd, 2014 - The Nassau County Police Department reports an arrest for Driving While Intoxicated on Saturday, December 20, 2014 at 11:55 P.M. in Hempstead.

According to police, Adrian N. Rubio, 27, of Dawes Avenue, Lynbrook was travelling southbound on Clinton Street when he was observed by a patrol officer driving in an erratic manner.  A car stop was conducted westbound on Front Street in the vicinity of Washington Avenue and an investigation discovered the defendant was under the influence of alcohol, his 13 month old son was a passenger in the backseat of the car, and he was driving with a suspended license.  He was placed under arrest without incident and the child was released to a family member at the scene.

Rubio is charged with Aggravated Driving While Intoxicated (Leandra’s Law), Endangering the Welfare of a Child, Driving While Intoxicated (+.08 BAC), Driving While Intoxicated, Aggravated Unlicensed Operation of a Vehicle 3rd degree and Vehicle and Traffic Law infractions.  He will be arraigned on Sunday, December 21, 2014 at First District Court in Hempstead.
