Da Vinci Lawsuit News: Rottenstein Law Group LLP Comments on FDA Report About Robot-Related Deaths, Injuries

Written by Long Island News & PR  |  12. November 2013

New York, NY - November 12th, 2013 - The da Vinci surgical robot system is linked to an increasing number of injuries and deaths, according to a Wall Street Journal article about a new report from the U.S. Food and Drug Administration. The Rottenstein Law Group LLP, which provides information on da Vinci lawsuits and side effects at www.davincilawsuit.us, notes that the report encompasses nearly the entirety of the device’s time on the market.

The draft analysis, which was co-authored by doctors at the Rush University Medical Center, the University of Illinois and Massachusetts Institute of Technology, studied the 5,000 adverse event reports to the FDA from January 2000 through December 2012, according to the Nov. 8 article. While the research team learned that issues such as malfunctions declined, there was an increase in deaths and injuries associated with da Vinci robot surgeries from about 13 for every 100,000 procedures in 2004 to 50 per 100,000 in 2012, the article said.

“This adds to the growing number of studies and reports that support the claims we hear about the dangerous alleged side effects associated with patients undergoing a procedure involving the surgical robot,” said Rochelle Rottenstein, principal of the Rottenstein Law Group LLP.

The da Vinci surgical robot features four mechanical arms with precision surgical tools and a camera which are designed to allow a surgeon to perform procedures such as prostate removals and hysterectomies less invasively than traditional methods. However, the medical device has been found to cause potentially dangerous side effects, such as internal burns, nerve damage and lacerations, according a July 12 Bloomberg article. Additionally, in July Intuitive Surgical initiated a class-2 recall of about 30 da Vinci units because of potential safety issues, according to Bloomberg.

Intuitive Surgical asserts that it is fully committed to superior training opportunities for surgeons and surgical teams in the use of its products, but notes that it does not participate in determining when a surgeon is adequately prepared to operate using the da Vinci Surgical System.
