Transvaginal Mesh Lawsuit News: Ethicon Cases Progressing in Federal Court

New York, NY - October 28th, 2013 - Johnson & Johnson subsidiary Ethicon’s vaginal mesh lawsuits are progressing in federal court in West Virginia. The Rottenstein Law Group LLP notes that while there are six different transvaginal mesh lawsuit consolidations for as many manufacturers, Ethicon is the only company not reportedly involved in mass settlement talks.

The most recent judicial order, issued by Judge Joseph R. Goodwin, who is overseeing the federal lawsuit consolidations, sets a schedule for future joint status conferences. The next one is Nov. 7 in Charleston, W.Va, according to court documents (C.R. Bard, American Medical Systems, Boston Scientific, Ethicon, Cook and Coloplast; MDLs-2187, 2325, 2326, 2327, 2440 and 2387; U.S. District Court for the Southern District of West Virginia).

“Typically, at these status conferences the parties’ respective lawyers discuss with the court the progress of the ‘multidistrict litigation,’ the consolidation intended to create efficiency in pretrial proceedings such as document discovery,” said Rochelle Rottenstein, principal of the Rottenstein Law Group LLP. “In order for coordination this sophisticated to function smoothly—we’re talking about tens of thousands of lawsuits nationwide—the parties need to meet regularly.”

C.R. Bard, Endo Health Solutions (American Medical Systems), Boston Scientific Corp., Coloplast and Cook Medical were said to be involved in settlement talks, according to Bloomberg. The value of the settlement and potential timeline were not available, but so far in 2013 Endo has already paid out more than $50 million in vaginal mesh settlements. The companies are looking to resolve more than 30,000 lawsuits nationwide, according to the article. Ethicon was not a reported participant in the talks at the time the Bloomberg article went to press.

Women are filing transvaginal mesh lawsuits alleging they suffered from adverse side effects such as pain and discomfort, in addition to device erosion, according to court documents. Vaginal mesh products were designed to enable doctors to treat pelvic organ prolapse and stress urinary incontinence.
