New York, NY - October 16th, 2013 - Amid news of a possible mass settlement of nationwide DePuy ASR lawsuits, the lawyers at the Rottenstein Law Group LLP discuss the status of Stryker ABG II and Rejuvenate lawsuits and settlements, and what those looking to file such lawsuits can expect out of possible settlement outcomes.

DePuy has been considering settling more than 11,000 ASR lawsuits for a blanket $3 billion, according to Bloomberg. While there has not been talk yet of settlements for Stryker’s recalled metal-on-metal hip implants, there is currently mass litigation underway in federal court in Minnesota.

“DePuy, being a subsidiary of Johnson & Johnson, is a big fish in this pond,” said Rochelle Rottenstein, principal of the Rottenstein Law Group LLP. “Stryker might very well take a cue from DePuy and look toward settling all of its own hip implant lawsuits at once rather than take its chances in court, one case at a time.”

Metal poisoning is among the most frequently alleged side effects of metal-on-metal hip implants such as the Stryker ABG II and Rejuvenate, according to the U.S. Food and Drug Administration. Also called “metallosis,” metal poisoning occurs when metal debris from the friction among the implant’s metal components sheds into and accumulates in a patient’s bloodstream.

In June 2013, about 300 Stryker hip lawsuits were consolidated in federal court in Minnesota, according to court documents (In re: Stryker Rejuvenate and ABG II Hip Implant Products Liability Litigation; MDL-2441, U.S. District Court for the District of Minnesota).
