NCPD: West Hempstead Man Arrested After Allegedly Driving High with Special Needs Passenger

Lynbrook, NY - October 12, 2018 - Lynbrook Police Department reports the arrest of West Hempstead man for an incident that occurred on Wednesday October 10, 2018 at 3:15 p.m. in Lynbrook.
According to detectives, Akiva Goldstein, 47, was observed by detectives operating a Hyundai northbound on Broadway with a defective brake light. A Vehicle and Traffic Law stop was conducted and during the investigation detectives smelled the odor of marijuana coming from the vehicle. After further investigation a glass pipe containing what is believed to be burnt marijuana and a plastic bag containing a substance believed to be marijuana was found in the console of the vehicle. The defendant was taken into custody without further incident. During the investigation it was determined the passenger in the vehicle was a special needs person and the defendant was responsible for driving the victim at the time of the arrest.
The defendant, Akiva Goldstein is charged with Endangering the Welfare of an Incompetent or Physically Disabled Person 2nd Degree, Criminal Possession of Marijuana 5th Degree and Unlawful Possession of Marijuana. He was released on an appearance ticket and will be arraigned on November 8, 2018 at First District Court, Hempstead.
A criminal charge is an accusation. A defendant is presumed innocent until and unless proven guilty.
