Driver Backing Out Driveway Becomes Enraged and Assaults 4-Year-Old Girl and Her Parents

Hicksville, NY - September 15, 2016 - The Second Squad reports an arrest for Assault which occurred on Thursday, September 15, 2016 at 12:40 p.m. in Hicksville.

According to detectives, the male victim, 34, was walking down the street on Atlas Lane with his daughter, 4 years of age, who was riding a bicycle.  As they approached a vehicle backing out of the driveway, the victim slapped the rear of the car to alert the driver of their presence, as they were almost struck by the vehicle.  The driver of the vehicle, David A. Wallach, 19, of Hicksville, exited the vehicle with a baseball bat to come after the victims. The victim was able to wrestle the bat away from him. 

At this time Wallach ran towards the 4 year old female victim and knocked her to the ground with his forearm, causing injuries to her back and neck area.  The victim picked his daughter up and brought her to safety at a neighbor’s house. 

The defendant then went down the street to the victim’s home and proceeded to break two front windows of the home by throwing baseballs through them.  The victim’s wife exited the home to see what the loud noise was and was shoved into a car by Wallach, causing an injury to her shoulder area.  When officers responded to the scene they located Wallach standing in the street and placed him under arrest without incident.  The 4 year old victim was taken to an area hospital for treatment to her injuries.

Wallach is charged with Assault 2nd degree, Menacing 2nd degree, Criminal Possession of a Weapon 4th degree, Criminal Mischief 2nd degree, Assault 3rd degree and Endangering the Welfare of a Child.  He will be arraigned on Friday, September 16, 2016 at First District Court in Hempstead.
