DA Sini: Two Men Indicted In Connection With Fatal 2017 Crash In North Amityville
Riverhead, NY - August 30, 2018 - Suffolk County District Attorney Timothy D. Sini today announced the indictment of two men in connection with a fatal motor vehicle crash in North Amityville in 2017.
Brian Wall, 32, of Central Islip, and Michael Plummer, 35, of Amityville, are each charged with Manslaughter in the Second Degree, a C felony; Assault in the Second Degree, a D felony; Reckless Endangerment in the Second Degree, an A misdemeanor; Reckless Driving, a misdemeanor; and Speeding, a traffic infraction.
“These two individuals allegedly tried to avoid taking responsibility for causing the death of a young man due to their reckless behavior at the time of this crash,” District Attorney Sini said. “Thanks to excellent investigative work by the Suffolk County Police Department and my office, they are now being held accountable for their actions.”
Wall was arraigned on the indictment today in front of Suffolk County Supreme Court Justice William J. Condon. Bail was set at $250,000 cash or $500,000 bond. Plummer was arrested by the Suffolk County Police Department today and is scheduled to be arraigned tomorrow.
At approximately 8:00 p.m. on April 2, 2017, Wall and Plummer were allegedly engaged in a high-speed race traveling southbound on New Highway in North Amityville when their vehicles sideswiped each other. Wall was driving a black 2007 Infiniti and Plummer was driving a silver 2008 BMW.
The crash caused Plummer’s vehicle to veer off the roadway and strike a fence. Wall’s vehicle struck the rear of a 2004 Chevrolet Blazer that was also traveling southbound on New Highway, causing the Chevrolet to overturn. His vehicle then struck two parked vehicles in front of 475 New Highway.
Wall allegedly exited his vehicle and was apprehended by police approximately a quarter mile from the scene of the crash. He is alleged to have stated to police that he was not the driver of the Infiniti.
Pierre Prophete, 23, of Copiague, who was a passenger in the Chevrolet, was transported to Good Samaritan Hospital Medical Center in critical condition immediately following the crash. He succumbed to his injuries on April 3, 2017.
An investigation by the Suffolk County Police Department’s Major Case Unit and detectives assigned to the District Attorney’s Squad revealed evidence that Wall was operating the Infiniti at the time of the crash and that he and Plummer had been racing.
If convicted of the top count, Wall and Plummer each face a maximum sentence of five to 15 years in prison.
Wall is due back in court on September 17. He is represented by Gregory Grizopolous, Esq.
This case is being prosecuted by Assistant District Attorney Daryl Levy, of the Homicide Bureau.
A criminal charge is an accusation. A defendant is presumed innocent until and unless proven guilty.
