Suffolk County Police arrested a man for Driving While Intoxicated under Leandra’s Law after he was pulled over in Huntington Station for a traffic stop with his young children in the car.

Miguel Cruz was driving a 2012 Nissan Rogue southbound on New York Avenue near Depot Road when a highway patrol officer initiated a traffic stop for speeding and failure to maintain a lane.

Cruz, 25, of Huntington Station was arrested and charged with Aggravated Driving While Intoxicated with a Child Passenger 15-Years-Old or Younger (Leandra’s Law). The passengers in the vehicle were his 2-year-old daughter, his 4-year-old son, his 25-year-old girlfriend Katherine Diaz, and his 16-year-old brother.

The children were released to the custody of Diaz.

Cruz will be held overnight at the Second Precinct and was arraigned at First District Court in Central Islip.

A criminal charge is an accusation. A defendant is presumed innocent until and unless proven guilty.
