Father Busted for Heroin Sale with Young Daughter in the Car

Oceanside, NY - March 24, 2014 - The Fourth Squad reports two arrests for Criminal Possession of a Controlled Substance on Sunday, March 23, 2014 at 7:08 P.M. in Oceanside.

According to detectives, Officers from the Fourth Precinct observed Kenneth Smith (pictured right), 38, of 41 Fifth Street, Valley Stream pull his car into the driveway of 482 Pearl Street.  Benedict P. Lindsley, 39, who resides there, came out of the home.  A drug transaction was performed before both men got into the car and traveled eastbound on Atlantic Avenue.  Officers pulled the car over on Clark Avenue after discovering it had a suspended registration.  Smith’s daughter, a minor, was in the back seat of the car, with no child restraint seat, at the time of the incident.  Smith was found to be in possession of three bags of heroin and placed under arrest without incident. Lindsley was also placed under arrest at the scene.  The child was picked up at the scene by a family member.

Smith is charged with Criminal Possession of a Controlled Substance 7th degree, Endangering the Welfare of a child and several vehicle and traffic law misdemeanors and violations including rear passenger under 10 without a restraint.  Lindsley is charged with Criminal Possession of a Controlled Substance 3rd degree, Criminal Sale of a Controlled Substance and Endangering the Welfare of a Child.  They will be arraigned on Monday, March 24, 2014 at First District Court in Hempstead.
