A Nassau County woman is suing pharmacy chain CVS after she claims that she received the wrong medication, which caused her great harm after she ingested it.
According to court documents originally filed with the Nassau County Supreme Court but then moved to the U.S. District Court for the Eastern District of New York last week, in 2024 Mary Lipman entered a CVS located at 17 East Jericho Turnpike in Mineola to have a prescription filled. However, the purports that the pharmacy did not give her the correct medication, and taking it caused her to suffer "serious" and "permanent" injuries
The lawsuit claims that CVS failed to properly train and oversee the staff working in its pharmacy, and that the company did not verify, dispense, and supervise its prescription fulfillment. The court documents also allege that CVS had prior knowledge of the unsafe conditions at the Mineola location that led to the medication mix-up, but did nothing about it.
The plaintiff is seeking monetary damages exceeding $75,000 - the full amount is not specified - for pain, suffering, and medical expenses.
CVS is denying that they filled Lipman's prescription incorrectly, or that the company is responsible for any pain or injuries she claims to have incurred.
