Queens Man Drove Drunk with Three Children, Ages 2, 6 and 11, in Vehicle, NCPD Says

Westbury, NY - February 6, 2019 - The Nassau County Police Department reports the arrest of a Queens man for DWI – Leandra’s Law on Wednesday, February 6, 2019 at 12:53 am in Westbury.

According to Police, Marshall McDermott, 29, was observed by responding officers operating a 2008 Chrysler Minivan. The vehicle was traveling westbound on Old Country Road without headlights. Officers activated their emergency lights and conducted a Vehicle and Traffic Law Stop.
 
A subsequent investigation was conducted and McDermott was placed under arrest without incident. The vehicle’s passengers included three minor children ages 2, 6 and 11 years old. The children were released into the custody of their mother. 
 
Defendant McDermott is charged with Driving While Intoxicated, three (3) counts of Aggravated Driving While Intoxicated (Child under 16) under the Leandra Law, three (3) counts of Endangering the Welfare of a Child, Inadequate Lights and License Plate Missing/Displayed Improperly. He will be arraigned on Wednesday, February 06, 2019 at First District Court, Hempstead.
 
A criminal charge is an accusation. A defendant is presumed innocent until and unless proven guilty.
