Transvaginal Mesh Lawsuits Update: Bid To Disqualify Expert Witness Overruled, Rottenstein Law Group LLP Reports

According to court documents, there was a Nov. 1 ruling that could be important to those who have filed or are looking to file vaginal mesh lawsuits.

Transvaginal mesh lawsuits involving implants manufactured by Endo subsidiary AMS are moving along in a consolidation of federal cases. A recent judicial order denied the plaintiffs’ request to disqualify one of the defendant’s anticipated expert witnesses because of alleged “side-switching,” according to court documents (American Medical Systems, Inc., Pelvic Repair System Products Liability Litigation; MDL-2325, U.S. District Court for the Southern District of West Virginia). RLG offers its opinion on the ruling and assures those who have filed or are looking to file lawsuits that they should not be discouraged by the order.

“Judge Eifert’s ruling that Dr. Matthews need not be disqualified from testifying as an expert witness on behalf of AMS is nothing that any current or potential vaginal mesh plaintiff should find troubling,” said Rochelle Rottenstein, principal of the Rottenstein Law Group LLP. “The decision makes it plain that Dr. Matthews was merely consulted once by lawyers for some mesh victims—when the litigation was brand new—and at that one meeting no confidential information was shared with her.”

AMS, along with C.R. Bard, Coloplast, Cook Medical and Boston Scientific are major mesh manufacturers who are considering settling tens of thousands of mesh lawsuits across the nation, according to a Sept. 30 Bloomberg report. Johnson & Johnson’s Ethicon is reportedly not a participant in the talks, the article said, which also indicated that AMS has already paid out more than $50 million in transvaginal mesh settlements so far in 2013.

Women are filing transvaginal mesh lawsuits alleging they suffered from serious adverse side effects such as pain, discomfort and device erosion, according to court documents. Vaginal mesh products are supposed to allow doctors to treat pelvic organ prolapse and stress urinary incontinence.
