According to detectives, Third Precinct officers on routine patrol observed a male operating a blue 2006 Suzuki motorcycle eastbound on Westbury Boulevard, Uniondale with a small child on the back. The officers observed that the child and the driver were not wearing Department of Transportation approved helmets. The driver was stopped at a red traffic signal on Westbury Boulevard and Oak Street when the officers activated both patrol vehicle lights to initiate a vehicular stop.

The officers exited the vehicle and when the driver saw the police officers approach, he sped away. The officers returned to their patrol car and followed.

When they reached the intersection of Commercial Avenue and Oak Street, they observed that the motorcycle had lost control and was down on the ground. Both persons had been ejected. The seven (7) year old male child was transported to a local hospital for minor injuries. He was treated and released to his mother. Defendant Donnell Waters, 30, was placed under arrest.

Subsequent to the arrest, a glassine and black plastic baggy containing a greenish brown leafy substance believed to be marijuana and twelve (12) individually packed glassine baggies containing what is believed to be crack cocaine was found on the defendants person. The helmets were identified as “novelty” German style helmets with no facial protection or Department of Transportation (DOT) rating.
