Rockville Centre, NY - March 11th, 2014 - Johnson & Johnson and its subsidiary Janssen Pharmaceuticals have agreed to settle a fraudulent marketing lawsuit filed by the Montana state Attorney General in 2008 for $5.9 million. According to a news release posted on the Montana Department of Justice Web site, Attorney General Tim Fox stated that Janssen Pharmaceuticals settled the lawsuit (Case No. CDV-2008-164) in February 2014, agreeing to cease its “illegal unfair and deceptive marketing of Risperdal®, an atypical antipsychotic drug used to treat certain psychological disorders in adults.” The lawsuit alleged that the manufacturer “actively deceived Montana physicians and consumers when it promoted Risperdal as safe and effective for a variety of conditions, when in fact, Janssen was aware of dangers associated with its drug that it hid from the public.”

Of the $5.9 million settlement, $1.5 million will be used to launch a Prescription Drug Abuse Prevention Program to address the growing number of young people in Montana who struggle with prescription drug abuse.

“All too often, drug abuse begins in our own homes with the misuse of prescription drugs found in our medicine cabinets,” Attorney General Tim Fox said in the news release. “Almost eight percent of Montana’s youth between the ages of 12 – 17 recently reported abusing prescription drugs. We need to do more to educate them, and their parents, about the dangers of these drugs. The Janssen settlement funds give us the resources we need to address the issue and focus on providing meaningful solutions.”
